1. Acceptance of Terms
Elysium Designs ("we", "us", "our") is a remote-first brand, UI/UX, and web design studio led by Shiva Bajpai. These Terms of Service ("Terms") form a binding agreement between you and Elysium Designs governing your access to and use of elysiumdesigns.in (the "Site") and any design, development, or consulting services ("Services") you engage us for. By accessing the Site, submitting a form, booking a call, or engaging our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.
2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the authority to enter into these Terms on your own behalf or on behalf of an organization you represent, to use this Site or engage our Services.
3. Use of This Site
You may browse this Site and use our contact forms, newsletter signup, and call-booking widget for legitimate, lawful purposes only. You agree not to:
- Misuse, disrupt, or attempt to gain unauthorized access to the Site or its underlying systems;
- Submit false, misleading, defamatory, or unlawful content through any form or widget on the Site;
- Use automated means (bots, scrapers, or crawlers) to extract data from the Site without our written consent;
- Introduce viruses, malware, or other harmful code to the Site.
We reserve the right to restrict or terminate your access to the Site at our discretion if we believe you have violated these Terms.
4. Services and Client Engagements
This Site describes the design, development, and consulting Services we offer, but it is not itself a platform for delivering client work. Project scope, timelines, deliverables, pricing, ownership of deliverables, and payment terms are agreed separately in a proposal, contract, or statement of work signed between you and Elysium Designs. Where a signed client agreement conflicts with these Terms, the signed agreement takes precedence for that engagement. These Terms otherwise continue to govern your general use of the Site.
5. Intellectual Property
Unless otherwise stated, all content on this Site, including text, graphics, logos, case studies, and design work, is owned by Elysium Designs or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws. You may view and share pages of this Site for personal, non-commercial reference, but you may not copy, reproduce, republish, or create derivative works from our content without our prior written permission.
6. Content You Submit
When you submit information through our contact form, newsletter signup, or booking widget, you grant us the right to use that information solely to respond to your inquiry, provide the Services you've requested, or send communications you've opted into, as described in our Privacy Policy. You are responsible for ensuring the information you submit is accurate and that you have the right to share it with us.
7. Third-Party Services and Links
This Site relies on third-party services to operate, including Cal.com for call bookings and Google Fonts for typefaces, and may contain links to third-party websites (such as our social media profiles). We do not control and are not responsible for the content, availability, security, or privacy practices of these third parties. Your use of any third-party service is subject to that provider's own terms and policies.
8. Disclaimers
This Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. 9. Limitation of Liability
To the fullest extent permitted by law, Elysium Designs and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of, or inability to use, this Site. Liability arising from a specific client engagement is governed exclusively by the terms of the signed agreement for that engagement, and nothing in these Terms limits or expands liability set out there.
10. Indemnification
You agree to indemnify and hold Elysium Designs harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have violated these Terms. Provisions of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) will continue to apply.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. Changes take effect as soon as they are posted here with an updated revision date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved informally by contacting us directly; if unresolved, it shall be subject to the exclusive jurisdiction of the courts of India.
